We work with you to generate 2nd and 3rd generation IP without R&D development to “stake out” areas of future value.

“Flyers” refers to the practice of filing patents on inventions, particularly those that are revolutionary, that, although technically possible, are 5+ years away from being practical. 

 Advantages of filing "Flyers":

 1.  You give yourself time.  It is usually much easier to develop IP than it is to actually make a marketable product.  You don’t have to rush to develop the invention (with the corresponding time and expense) because you now have a 20 year window of exclusivity; you can work on the invention as you have time and resources.  Filing a “Flyer” allows you to “stake out” areas of future value without spending a lot of time and money now for R&D.

 2.  You minimize the risk that someone else will get a patent on the invention before you do.  Nothing happens in a vacuum.  If you invent something now but don’t do anything with it, sooner or later someone will come along and invent the same thing.  If you waited to file on these inventions until they are practical, you risk having someone else get patent protection on these inventions before you do.  This, in most cases, prevents you from getting patent rights in the invention. 

 3.  By filing early you maximize the scope of the patent protection you are likely to get.  Early on in the lifecycle of revolutionary inventions, there is usually little “prior art” that limits the scope of patent protection.  As time goes on, more and more “prior art” comes into existence thus limiting the scope of patent protection that is available.  By filing early you increase the chance of getting larger patent scope than if you wait to file later.
