What is an IP Strategy and how do I get a good IP Strategy?

An IP Strategy is a written plan identifying:

·        Exactly what is important to your business and why it is important

·        What IP you already have and how valuable it is to your business

·        What areas you can develop IP in to give your business a competitive advantage

·        How you can broaden your IP to maximize the scope of protection it can afford you

·        Where your IP fits into the broader IP landscape including identifying

o       trends in your industry and

o       opportunities for proactive IP development to give your business a competitive edge

·        Where your competitors’ IP is located so you can:

o       avoid it and

o       take efforts yourself to cause them problems

 Most businesses don’t have an IP Strategy or if they have one, it is rudimentary and usually unwritten.  As a result, their rudimentary IP Strategy or their actual approach to IP can’t possibly be aligned with their Business Strategy.  In fact, their IP Strategy is often wholly disconnected from their Business Strategy. 

 These businesses often take a reactive approach to IP.  When they create or develop something new they have a gut feeling that they need patents to protect their investment in R&D and give them exclusivity on that feature and hence a marketing advantage.  So they file patents on these new things without regard for whether these patents are the best use of their money or with assurance that these patents will give them a strategic business benefit or advantage.

 When it comes to IP (Intellectual Property), most businesses are confused about what they can and can’t do, how IP is related to actual product development, what should be patented or not patented, what types of patents to get and how to align their IP work with their Business Objectives.  Because of poor information, poor direction, an incomplete understanding of what is valuable to their business and poor processes, poor decisions often result relating to obtaining and using IP. 

 Further, most business people are uncertain as to how to use their IP as an active and vital part of their Business Strategy.  Consequently, they often rely on their patent attorneys to give them advice with respect to IP including what they should file patent applications on and what types of patents to get.  But, most patent attorneys don’t have the business training or experience necessary to help align an IP Strategy with a Business Strategy or consider it their job to do so.  more
